Fulton County Grand Jury Hands Down Nine Indictments

On May 15, 2023, the Fulton County Grand Jury considered indictments charging individuals with Fulton County crimes, according to the Fulton County Prosecuting Attorney’s Office.

JUSTIN J. MORRIS, age 27, of Wauseon, OH, was indicted on two counts of Strangulation and one count of Domestic Violence. On or about May 1, 2023, he allegedly caused or created a substantial risk of physical harm to another by means of strangulation. He also allegedly caused or attempted to cause physical harm to a family or household member. 23CR48.

MICHAEL X. DAVIS, age 18, of Zion, IL, was Indicted on one count of Receiving Stolen Property. On or about April 18, he allegedly received, retained or disposed of a motor vehicle, knowing it had been obtained through the commission of a theft offense. 23CR47.

RYAN A. MONTOYA, age 29, of Smithsburg, MD, was Indicted on two counts of Aggravated Possession of Drugs. On or about March 21, 2023, he allegedly possessed two controlled substances or controlled substance analogs. 23CR57.

KEVIN L. THATCHER, age 35, of Swanton, OH, was indicted on one count of Disrupting Public Services and one count of Domestic Violence. On or about April 25, 2023, he allegedly impaired or interrupted telephone communications services being used for emergency communications. He also allegedly caused or attempted to cause physical harm to a family our household member. 23CR55.


CHRISTOPHER L. SHOEMAKER, age 37, of Delta, OH, was Indicted on one count of Furnishing Alcohol to an Underage Person, one count of Corrupting Another With Drugs, one count of Unlawful Sexual Conduct With a Minor, and one count of Rape. During the month of November 2020, he allegedly furnished alcohol and Marijuana to an underage person, and he allegedly engaged in sexual conduct with a person who was 13 years of age or older but less than 16 years of age. 23CR54.

MARCUS K. BAILEY, age 46, of Wauseon, OH, was indicted on one count of Failure to Provide Notice of a Change of Address. On or about March 8, 2023, he allegedly failed to notify the appropriate sheriff of a change of address. 23CR53.

JOSEPH J. LOPEZ, age 28, of Delta, OH, was indicted on one count of Failure to Provide Notice of a Change of Address. On or about November 2022, to May 15, 2023, he allegedly failed to notify the appropriate sheriff of a change of address. 23CR56.


JOHN M. STASA, age 74, of Swanton, OH, was indicted on one count of False Registration and five counts of Illegal Voting. On or about March 10, 2020 to November 8, 2022, he allegedly registered to vote in a precinct in which he was not a qualified voter. He also allegedly voted or attempted to vote in a precinct in which he was not a qualified voter. 23CR52.

HERBERT D. RHOADES, III, age 50, of Parma, OH, was indicted on one count of Passing Bad Checks and one count of Theft. On or about March 4, 2023 to March 7, 2023, he allegedly with purpose to defraud, issued checks knowing they would be dishonored to a single vendor for the payment of $1,000 or more but less than $7,500. He also allegedly obtained control over property by deception, said property valued at $1,000 or more but less than $7,500. 23CR51.

It should be noted that an indictment Is merely an accusation, and that all criminal defendants are presumed Innocent until and unless proven guilty.
