FULTON COUNTY COMMON PLEAS
A Napoleon woman was sentenced on December 16, 2016 in the Fulton County Common Pleas Court according to county prosecutor Scott A. Haselman. Shannon Baumbarger, age 34, previously pled guilty to Grand Theft. On or about July 9, 2016, she stole a rifle. Judge James E. Barber sentenced Ms. Baumbarger to 3 years of community control and ordered her to pay prosecution costs and court appointed counsel fees, seek and maintain employment, pay restitution of $1,525 to the victims, successfully complete the Serenity Haven drug treatment program and all aftercare, have no contact with the victims, stay out of bars/taverns, and not possess or consume alcohol or any illegal substances. Failure to comply could result in Ms. Baumbarger spending 30 months in prison.
A man formerly of Lyons, OH, was sentenced on December 16, 2016 in the Fulton County Common Pleas Court according to county prosecutor Scott A. Haselman. Rickey Lamb, Jr., age 25, was found guilty of Aggravated Arson, Insurance Fraud, Grand Theft, Telecommunications Fraud, and Falsification in a Theft Offense. On January 3, 2015, he set fire to an occupied structure in Lyons. He then filed a false claim with an insurance company. Judge James E. Barber sentenced Mr. Lamb to 6 years in prison for Aggravated Arson, 11 months in prison for Insurance Fraud, 11 months in prison for Grand Theft, 11 months in prison for Telecommunications Fraud, and 11 months in prison for Falsification in a Theft Offense, to be served concurrently with one another, for a total term of 6 years, and to pay restitution of $18,500 to the insurance company.
Two individuals were sentenced on December 20, 2016 in the Fulton County Common Pleas Court according to county prosecutor Scott A. Haselman. Tara Zuber, age 26, of Sylvania, OH, previously pled guilty to Operating a Vehicle While Intoxicated and Attempted Improperly Handling Firearms in a Motor Vehicle. While driving on July 2, 2016, she attempted to transport a handgun while under the influence of alcohol. Judge James E. Barber sentenced Ms. Zuber to 2 years of community control and ordered her to complete a 3 day driver’s intervention program, in lieu of 3 days in jail, forfeit her firearm to the State, forfeit her interest in her vehicle to the State, stay out of bars/taverns, not possess or consume alcohol or any illegal substance, pay a $375 fine, and suspended her license for 6 months, with driving privileges for work, probation appointments, and attending the driver’s intervention program. Failure to comply could result in Ms. Zuber spending 177 days in CCNO for OVI, and 177 days in CCNO for Attempted Improper Handling of a Firearm, to be served concurrently with one another, for a total jail time of 177 days.
Wendy Whaley, age 48, of Swanton, OH, previously pled guilty to Theft and Forgery. Between November 26, 2012, to December 9, 2014, she stole property valued at $1,000 or more. On September 3, 2014, she forged a check. Judge James E. Barber sentenced Ms. Whaley to 4 years of community control and ordered her to have no contact with the victims, pay restitution of $10,700 to the victims, complete a theft education course, seek and maintain employment, and serve 15 days in CCNO within a 120 day period. Failure to comply could result in Ms. Whaley spending 10 months in prison for Theft and 10 months for Forgery, to be served concurrently with one another, for a total term of 10 months.
A Wauseon woman was sentenced on December 22, 2016, in the Fulton County Common Pleas Court according to county prosecutor Scott A. Haselman. Alexandria Lee, age 18, previously pled guilty to Attempted Possession of Cocaine. On April 13, 2016, she attempted to possess cocaine. Judge James E. Barber sentenced Ms. Lee to one year of community control and ordered her to pay a $250 fine, successfully complete all treatment and aftercare at Recovery Services of Northwest Ohio in Defiance, stay out of bars/taverns, not possess or consume alcohol or any illegal substance, serve 10 days in CCNO, and suspended her driver’s license for 6 months, with driving privileges for work, treatment, and probation appointments. Failure to comply could result in Ms. Lee spending an additional 170 days in CCNO.
A man formerly of Archbold, OH, was sentenced on December 23, 2016, in the Fulton County Common Pleas Court according to county prosecutor Scott A. Haselman. Preston Klopfenstein, age 21, previously pled no contest and was found guilty of Assault and Aggravated Menacing. On September 23, 2015, he knowingly caused physical harm to another. He also knowingly caused another to believe that he could cause them serious physical harm. The plea agreement was reached after a psychiatric evaluation found that at the time of the incident, Mr. Klopfenstein suffered from a mental illness which prevented him from understanding the wrongfulness of his acts. Judge James E. Barber sentenced Mr. Klopfenstein to 2 years of community control and ordered him to pay prosecution costs, pay a $250 fine, successfully complete treatment at A Renewed Mind, take medications as prescribed, be gainfully employed or be enrolled in an institution of higher learning, and serve 7 days in CCNO, with credit for time served. Failure to comply could result in Mr. Klopfenstein spending 173 days in CCNO for Assault and 173 days in CCNO for Aggravated Menacing, to be served concurrently with one another, for a total of 173 days.
