Two individuals were sentenced on February 21, 2019, in the Fulton County Common Pleas Court according to county prosecutor Scott A. Haselman.
Joseph Branham, 32, of 805 S. State Street, Pioneer, previously pleaded guilty to Possession of Heroin. On May 18, 2017, he possessed Heroin.
Judge Jeffrey L. Robinson sentenced Mr. Branham to 2. years of community control and ordered him to pay prosecution and court-appointed counsel costs, stay out of bars/taverns, not possess or consume alcohol, and be successfully discharged from treatment at Recovery Services of Northwest Ohio.
Failure to comply could result in Mr. Branham spending 10 months in prison,
Donald Kerr, III, 29, of 412 E. Chestnut St., Wauseon, plead guilty to Aggravated Possession of Drugs, Possession of Heroin, and Operating a Vehicle While Intoxicated. On July 3, 20181 he possessed Methamphetamine. On September 7, 2018, he operated a vehicle while under the influence of drugs, while possessing Heroin.
Judge Jeffrey L. Robinson sentenced Mr. Kerr to 2 years of community control and ordered him to pay prosecution costs, pay a $375 fine, stay out of bars/taverns, not possess or consume alcohol, be held at CCNO until a bed becomes available for the SEARCH Program, successfully complete the SEARCH Program, and all aftercare, successfully complete the Drug Court Program, and suspended his driver’s license for six months.
Failure to comply could result In Mr. Kerr spending 8 months in prison for Aggravated Possession of Drugs; 8 months in prison for Possession of Heroin; and 3 days in CCNO for OVI. Prison terms for Aggravated Possession of Drugs and Possession of Heroin to be served consecutively with one another, and OVI to be served concurrently with the charge of Possession of Heroin, for a total prison term of 16 months.
