Two Fulton County residents were sentenced on March 22, 2019 in the Fulton County Common Pleas Court according to County Prosecutor Scott A. Haselman.
Carl Garza , Jr., age 49, Wauseon, previously pled guilty to Trespass in a Habitation When a Person is Present or Likely to be Present, and Breaking and Entering. According to Fulton County Prosecutor Scott Haselman, on or about September 13, 2018 Mr. Garza trespassed in an occupied structure when any person was present or likely to be present, with purpose to commit a criminal offense. On September 29, 2018, Mr. Garza trespassed in an unoccupied business with intent to commit a theft offense.
Judge Jeffrey Robinson sentenced Mr. Garza to three years of community control. He ordered Mr. Garza to pay prosecution costs and court-appointed attorney fees; pay restitution in the amount of $250; successfully complete the SEARCH Program and any recommended aftercare; not consume or possess alcohol or illegal drugs in his home or vehicle; not enter bars and/or taverns; comply with an 11:00 p.m. to 6:00 a.m. curfew; and have no contact with the victim.
Failure to abide by these conditions could result in Mr. Garza sewing 28 months in prison.
Thomas Partin, 52, of 5832 Co. Rd. 1-2, Swanton, previously pled guilty to Possession of Cocaine. On November 11, 2017, he possessed Cocaine.
Judge Jeffrey L. Robinson sentenced Mr. Partin to 2 years of community control and ordered him to pay prosecution costs, stay out of bars/taverns, not possess or consume alcohol, serve 60 days in CCNO with credit for days already served, and be assessed for dual-diagnosis at Renewed Mind, and successfully complete any treatment recommendations.
Failure to comply could result in Mr. Partin spending 11 months in prison.
