Delta Man Among Three Individuals Sentenced In Fulton County Common Pleas Court

Three men were sentenced on March 28, 2019, in the Fulton County Common Pleas Court according to county prosecutor Scott A. Haselman.

Benjamin Wagner, 44, of 923 Linwood Ct., Delta, previously pleaded guilty to Operating a Vehicle While Intoxicated. On September 29, 2018, he operated a motor vehicle while under the influence of alcohol.

Judge Jeffrey L. Robinson sentenced Mr. Wagner to 2 years of community control and ordered him to pay a mandatory fine of $1,350, serve 90 days at CCNO, be on TAD monitoring for 180 days after completion of jail time, successfully complete treatment at A Renewed Mind, suspension of driver’s license for 5 years, stay out of bars/taverns, not possess or consume alcohol, and forfeit his vehicle to the State of Ohio.

Failure to comply could result in Mr. Wagner spending 12 months in prison.


AJalen N. Brimmer, age 22, Wauseon, previously pled guilty to Attempted Tampering With Evidence. According to Fulton County Prosecutor Scott Haselman, on or about October 5, 2018, Mr. Brimmer attempted to tamper with evidence in an official police investigation.


Judge Jeffrey Robinson sentenced Mr. Brimmer to three years of community control. He ordered Mr. Brimmer to pay prosecution costs and court-appointed attorney fees; pay a fine of $500; successfully complete treatment at Recovery Services of Northwest Ohio; successfully complete the Cognitive Behavioral Treatment Program of the court; not consume or possess alcohol or illegal drugs in his home or vehicle; not enter bars and/or taverns; and comply with an 11:00 p.m. to 6:00 a.m. curfew.

Failure to abide by these conditions could result in Mr. Brimmer serving 14 months in prison.


AJustin Hahn, 32, of 117 Washington, Wauseon, previously pleaded guilty to Domestic Violence. On August 26, 2018, he did by threat of force, knowingly cause a family or household member, to believe that he would cause imminent physical harm to them.

Judge Jeffrey L. Robinson sentenced Mr. Hahn to 30 days in CCNO, with work release, and ordered him to pay prosecution costs.
